[CPAP] IS PRESCRIPTION NECESSARY

IS PRESCRIPTION NECESSARY
Dear members

I want to buy a CPAP machine for (Sleep Apnea) from US. I got a Rx from Indian Doctor. But in US suppliers said they need a Rx from US doctor. What can be done ? Need advise . Is prescription really necessary to buy online?

In the US a prescription is required.

It does not matter where you are located.
US distributors must be licensed and have a valid prescription to dispense. And any person in the US must have a prescription. This is in compliance with US Federal law.

If it's a U.S.-based Amazon seller, and they state that there is no prescription required, I would be very reluctant to purchase a CPAP from them. If they obviously don't care about following the law they likely won't feel bad about sending you a non-functioning CPAP machine.. or no CPAP at all.

It may be that sellers located in the US can legally sell to people in other countries who don't have prescriptions, provided those countries don't have a law against it.

There is legal and then there is the contract with the manufacturer. I don't know of any company that lets their resellers sell into someone else's territory. Some other company is under contract to sell in the other area. If they get caught they could lose the product line.

Look for an online supplier that sells internationally. Only one that says they do that knows how to ship to you.

Supplier #1 says they will ship CPAP products internationally, based on a foreign prescription. However, due to manufacturer's policies, they will not ship ResMed or Philips Respironics internationally.

That's true up to a certain point. Under the Sherman Antitrust Act you can not prevent someone from selling anywhere, including in another's territory. However you can pull their representation of your products or choose not to support the product if the sale is made.

I just realized that I'm belaboring the point.
