Well I think I'm going ok with my CPAP... 

I seem to be staying compliant, which is what I need to be to maintain my commercial driving licence.  Smile

I don't know what the compliance requirement is for Australian CDL, but you seem to have the hours and efficacy that it takes. Hopefully you have regained the concentration it takes to stay on the road, and not used fixed objects to slow your momentum. Smile

You are one of the unlucky ones. My sleep study tests never made it to the QLD Department of Transport and that is the case for the majority of Aussies as far as I know.

Four hours per night minimum, AHI below 5 maybe?? (can't remember, but I'm well under whatever it is I think), and 80% of nights use.... has to be signed off on by my specialist prior to licence renewal each year.

That wasn't a black out.. that was chasing my mates on their dirt bikes up a fire trail on a road going sidecar/outfit and hitting a pothole that threw me off line.

That was classed as an "undiagnosed blackout" at the time of the accident, in truth it was ten years of sleeping less than five hours per night finally catching up with me.. I fell asleep at the wheel 14 hours after I got up, having had only three hours sleep that night (never have been a good sleeper for my whole life, my brain just refuses to stop working and switch off for sleep)

My eyes are perfect, I can see things from hundreds of metres away.. it is when I get close to them that I can't see sh*t.  Unsure 
(actually, among the myriad of tests I had before my licence was reinstated was a comprehensive eye test, low strength reading glasses is all I need for reading/computer work.. driving and normal stuff needs no correction with glasses, my distance eyesight is better than average.. pretty damned good considering I'm almost 63 years old  Cool  )

My licence was suspended on the spot by the Cops based on medical grounds at  the scene of my accident, I was carted off to hospital where the ER doctor decided I'd had a "blackout caused by unknown medical reasons".... the falling asleep due to sheer lack of sleep is not considered a cause of an accident, even though we are hounded constantly by television commercials every time a holiday break comes up telling us how fatigue and a microsleep is even more dangerous than driving drunk. 
Now I have to stay compliant each year to maintain my commercial driving status, if I'd just gone back to a private licence with no endorsements I'd not have to stay compliant I believe.

I believe that you could easily challenge both of those decisions.

1 The cops have no medical qualifications to allow them suspend your licence on the spot. They can do it for the likes of dangerous driving (requires evidence) and obviously for driving with a blood alcohol level above 1.0. Apart from that they can't do anything else, only a court can do that. Did your licence suspension go through the courts?

Conditions which affect safe driving

Various medical conditions can affect your ability to drive safely, for example:
  • Blackouts, fainting or other sudden periods of unconsciousness
  • Vision problems
  • Heart disease or stroke
  • Epilepsy
  • Sleep disorders
  • Diabetes
  • Psychiatric disorders
  • Neurological disorders
  • Age-related decline.
Usually, this doesn’t mean that you can’t drive at all, but you may need to provide a satisfactory medical report before you can apply for, or renew your licence. In some cases you may also be required to pass a driving test.

Driving fatigue is so common an Aussie roads that either your accident was spectacular or you got the wrong cop/doctor. The number of truckies I know who have OSA yet don't do anything about it is frightening.
