I Sent A Letter To Get My Records - Schnauzers 5 - 04-20-2013

I sent a letter; I did not fill out the form to that bankrupt sleep center. I still do not have my medical records. There is no number to speak to anyone. I told them I do not give permission to sell my records or do anything with them. I told them to mail me copies and then delete them. No answer.I never paid a dime co pay so they have no credit card info. I never complete my social number cuz they state has that. I just wanted the records.

The nearby hospital said they went bankrupt. Oddly the forms' address is Wilmington, Mass, near where the Boston tragedy happened. I think they were just mismanaged. Now they are all just gone. Who knows where those records are now.......

Interesting that they cannot be found right after April 15th. They must have taken their tax write offs and moved to Tahiti with all their riches.

If they filed for bankruptcy it would be a court case which is a public record. Call your local federal court system and ask them where to find the records. The cases may even be accessible online.

Most importantly, if the case is not yet final you can file a claim as a creditor to whom the company owes something (your records). You can even appear at the hearing and ask the judge to enter an order requiring them to deliver your records to you.

They may not have actually gone bankrupt. They may have just gone out of business. Even if not all their creditors were paid they could have just locked the door and left for the Cayman Islands.

Whether they go bankrupt or just go out of business I'm pretty sure federal law requires them to transfer your records to another provider with notice to you where they sent them. There may be a federal enforcement agency you can contact, but I'm too lazy to google for it. Smile

I would suggest you contact your insurance company. They be able to advise you on what you can do to get your records. Like you, they paid for them and have a legal right to them. Also, you can call whichever doctor it was who ordered that study. That office should also be able to assist you in obtaining those records.

I will look into as soon as I have a day off on a week day. I do not drive to Phoenix no way, no how. In fact I just got a summons for jury duty in Phoenix for superior court. I can not sit for long periods such as jury, due to frequent potty visits . I can call my state Ins provider and see if they can help. My primary doctors' staff is not too efficient. I am still waiting for my recent blood work copies and I only live about six miles away and nothing in the mail yet. Geesh.

Examples of stupity among the younger generation:

Clerk at Mc Donalds " We only have six, nine or twelve Mc Nuggets, we don't have half a dozen."

" We don't have sweeteners, just Splenda and sugar".

In the check out line, separating items from the next customer, the clerk picks up the bar separator and asks , " Do you know how much this is?"
No, I have changed my mind." customer says. " Ok," says clerk with no clue. These are true stories, no joke.

Last weekend at a church picnic, I commented that the song " Preacher Man" You know, "the only one who could ever reach me, was the son of a preacher man.". The church service was over, and Jeremy, the son of the senior pastor, also a preacher who just taught. I said to someone while music playing, " I bet Michelle J. must love that song. ", Huh? They had no clue who Jeremy was or Cal, both pastors at the church. Michelle, being Jeremys' wife. Jeremy the son of the preacher man. DUH.

If you were at the service, his name is under him on the screen and he also tells you his name, not necessarily he is Cals' son, but hey, they do have the same last name, with a family resemblance. I dunno.....lol. Some people are clueless.DielaughingHuhsign

If you are referring to the company that had their main office in Dallas, they did file for bankruptcy. Filing numbers showed assets of around 100-500,000 and liabilities 10 times that. That was back in 2011. Just do a google search on their name and bankruptcy. I was looking for their contact info when I came across the article. When I asked my insurance company about it they said don't worry about it and sent me documentation as such. My ENT (sleep doc) set me up with a new study and it resulted in a new machine and company which has been fantastic. BTW, I was contacted by the folks that the courts appointed and they wanted to make sure I had someone who was taking care of me. When I asked about the med records, I was told they courts still have them. (That was back in November).

Actually, different company based in Mass. The affiliated hospital ( some woman who answered the phone ) said bankrupt. The letter said this past January. Oddly, I got a call from them for a check up I think last November/Dec but I declined because nothing ever changes with me, and was a waste of time. I will call my Ins company and see what they know.


BTW I have a client who works for sleep doctors/lung specialists. ( in house sleep labs too ) I will call her to set up an appt. It would be great if I could get a new Rolls Royce of a c-pap s9 with all the bells and whistles. I also might not be able to continue to get supplies without a doctor. My current machine is mostly quiet but when my head is on the pillow I hear a soft sound almost like rain on the roof. Not bad, but silent might be even better. It was totally silent when I first got it. My hoses are not old or worn or my pillows or headgear. I would think I need a doctor for insurance to continue even if it is State funded. Wouln't you think? Ins never notified me however.
