Disclaimer & Legal Information

Apnea Board is an educational public discussion forum. It is open to all, but subject to control of the moderators and administrators. Members must be 18 years of age or older to create or use a forum account. We make a promise to our members that Apnea Board operations will never be influenced by commercial interests. Apnea Board exists for the benefit of Sleep Apnea patients. Funding for operations comes primarily from member donations. Apnea Board is not a 501(c)(3) corporation, therefore donations are probably not tax-deductible. If you have questions, consult your tax accountant.

Apnea Board is not a publisher; we do not screen posts or Wiki entries before they are available for general viewing. Although the administrators and moderators of Apnea Board will attempt to keep all objectionable messages off the forums, it is impossible for us to review all messages. All forum postings and Wiki entries express the views of the author, and neither the owners, operators, moderators or members of Apnea Board will be held responsible for the content of any message. Any information, and content of a forum posting or wiki entry is the sole responsibility of the user.

We do not endorse or guarantee the accuracy of any post or Wiki entry made here and therefore we assume no legal responsibility for any post or wiki entry. Any information on our website or in our forums should not be considered as medical advice. Always seek the advice of a qualified physician before seeking treatment for any medical condition, including Sleep Apnea. Apnea Board will not be held liable for any damage or injury caused by incorrect information published or posted on our website or forums. We reserve the right to apply software filters to automatically manage inappropriate terms, links, spam, words, etc. We also reserve the right to edit or delete posts or other user-provided content as necessary.

By using the forums, website or the Apnea Board Wiki, Apnea Board Forum Members and Wiki Editors are expressly licensing Apnea Board for the use of that content on the wiki, the ApneaBoard.com website, the SleepFiles.com website, the Apnea Board Forum and any other web-based media owned and operated by Apnea Board, regardless of any other claims of copyright ownership the author/editor of the article may make. Forum members and Wiki Editors agree to license Apnea Board for the perpetual, free and gratuitous use of any and all content posted or uploaded to the Wiki or posted on the Apnea Board forum and websites (in part or in whole). [This includes any text, image files, video files, audio files, computer software files, data files or any other file types that are presented in, embedded in, attached to or linked to within a forum post or wiki article or content located on other websites owned and operated by Apnea Board]. Wiki Editors further agree that by posting on the forum or editing a wiki article, or by uploading any file, they are relinquishing any ownership or copyright claims upon that text or file and that all forum posts, wiki articles, edits and files become the sole unique property of Apnea Board. No Apnea Board forum post content, Wiki article text, image file, video file, audio file, computer software file, data file or any other file types that are presented in, embedded in, attached to or included in a wiki article may be used outside of this wiki or the ApneaBoard.com domain without express written permission of Apnea Board.

The decision of Apnea Board to delete any post or wiki entry reflects the administrator's or moderator's view that the deleted post or entry is inconsistent with the overall goals and purposes of the board, and is not a determination that such post or entry is obscene, libelous, or is otherwise in violation of law. Likewise, the decision to ban a poster reflects only our conclusion that such poster has demonstrated an inability to conduct him/herself in an overall manner consistent with the goals and purposes of Apnea Board and is not a determination that such poster has violated any law.

Persons or businesses are always free to post a response to any post with which they disagree or which they believe is factually incorrect. Apnea Board will not entertain a deletion request by anyone claiming to be harmed by misstatements of fact in a posting or wiki entry unless that person has first posted a response correcting the alleged misstatement. Absent such a response being posted, we will assume the complaining party either has no contradictory information or is interested only in causing mischief. We will consider qualifying requests that a post or wiki entry be deleted upon presentation of credible information tending to show that the post or wiki entry is false in a material respect. We will not entertain a request that a post or entry containing nothing more than expression of personal opinion be deleted (for instance, posting, "The ABC CPAP machine is a piece of junk,") even if that opinion is highly unfavorable.

Privacy on Apnea Board is of utmost importance. As such, all information that is provided to us during registration is kept confidential and will not be disclosed to third parties for any reason, unless required by law.

Although Apnea Board attempts to protect data submitted to our forums and website, by using our website, all visitors and users agree that they are waiving all rights to privacy or claim of ownership of data submitted to our website or forums and all users hereby waive any perceived rights covered under the European GDPR (General Data Protection Regulation) or any other international organization that falsely claims to have regulatory authority over U.S.-based websites. Apnea Board, being based in the U.S., is subject to constitutionally-valid United States laws alone, not arbitrary foreign laws. In addition, Apnea Board is not subject to unconstitutional or arbitrary laws or regulations created by a jurisdiction or state located within the United States.

We are making such material available in our efforts to advance the understanding of Sleep Apnea treatment and to advance the educational level of Sleep Apnea patients with regard to their health.
